VISA H-2A AND H-2B: JOB OPPORTUNITIES IN THE U.S. FOR FOREIGN WORKERS

If you are looking for opportunities to work in the U.s. for a short time, Visa H-2A and H-2B can be the right choice for you. This is the temporary visa is granted to foreign workers to the U.s. working in the industry labor shortage, including agricultural work and non-agricultural.

1.     Visa H-2A Visa Agricultural Workers Temporarily

Visa H-2A is issued to those foreign workers want to work in the agricultural sector in the Us. This is a temporary business visas, for those who intend to work in the agricultural sector and the related work, such as harvesting crops, plant care, or working at the farm.

2.     Visa H-2B Visa Workers in Non-Agricultural Temporary

Visa H-2B for foreign workers wishing to work in the industry of non-agricultural in the U.s., for example, travel, construction, work in the resorts, or temporary jobs that are not related to agriculture.

Conditions to apply for a Visa H-2A/H-2B:

  • The employee must be offered a job at a company in the Us.
  • Need to have an invitation from the employer and prove that there are not enough American workers can do the job.
  • Work in the U.s. must be temporary and seasonal nature (usually from a few months to a year).
  • Workers must prove that they will return to their countries after the work ends.

Step 1: employer registration with The Us department of Labor

The employer will have to apply for a certificate of temporary workers in The U.s. Labor department, proving that they can't hire enough labor, domestic work to do.
After obtaining the certificate of temporary workers from the Ministry of Labour, the employer can file an I-129 up by USCIS to apply for recruitment of temporary workers abroad.

Step 2: apply for a visa at a Us Consulate

Workers will receive job offers and Certification of Temporary Workers from employers, then apply for a visa DS-160 at the American Consulate. Book an appointment visa interview, follow the instructions of the embassy or Consulate.

Step 3: visa Interview
Workers will join the visa interview at the Us Consulate. Need to prepare the following documents:

  • Valid passport
  • Invitation letter work from home careers
  • Certificate of Temporary Workers from The Labor department
  • Visa application form DS-160
  • The receipt number printed on the guarantee I-129 approved
  • Appointment letter interview
  • Receipt of paid visa fee
  • Other documents (if required)

*** In the interview, employers need to demonstrate that they intend to return to your home country after your visa expires.

Step 4: Wait for approval and get visa
After the interview, if the profile is approved, visa H-2A/ H-2B will be granted, and workers can work in the Us in the industry temporarily according to the signed contract.

Duration of visa H-2A/ H-2B

The initial time a visa for a maximum of 1 year. Visa H-2A/ H-2B can be renewed once or more times, but the total duration of stay in the U.s. continuously not be more than 3 years. After 3 years, the workers must return to water for at least 3 months before you can apply for another visa H-2A/ H-2B if you still want to continue to work in the united states.
