THE EB-3 EMPLOYMENT-BASED IMMIGRATION PROGRAM

Program EB-3 (Employment – Based Third) was established by the U.S. government in 1990 as an employment-based immigration program that requires sponsorship from a U.S. employer. EB-3 is divided into three categories:

Professionals: are individuals whose job requires at least a U.S. bachelor's degree or its foreign equivalent and are members of that profession.

Skilled workers: are individuals who perform jobs that require at least 2 years of training or experience, are not temporary or seasonal in nature. Skilled workers must meet the education, training, or experience requirements of the job opportunity. Relevant post-secondary education may be considered as training.

Other workers (Unskilled workers or Miscellaneous workers): is for individuals who perform unskilled labor that requires less than 2 years of training or experience, and is not temporary or seasonal in nature.

The eligibility requirements for the EB-3 program:

  • Are individuals within the working age range (18 - 55 years old).
  • Ensure that you meet the health standards to fulfill the job requirements.
  • No criminal record, not deported from the United States.
  • Work full-time according to the regulations of U.S. employers.
  • There is no need to provide financial proof.
  • Language proficiency: depending on the nature of the job.

  • Obtain employment immediately upon arrival in the United States with a good income.
  • Spouses and unmarried children under 21 years old of the applicant are also granted green cards, allowing them to study, work, and enjoy social benefits like U.S. citizens.
  • Children are exempt from tuition fees at public schools in the United States until high school graduation. Tuition fees at universities are only one-third of the fees for international students (depending on state regulations).
  • Being free to do business and work in various fields.
  • Being eligible for U.S. citizenship after 5 years of living and working.

The process of filing an EB-3 program application:

  •  Request for Labor Certification.

If the worker meets the job requirements, the U.S. company will assist them in submitting an application for Labor Certification (LC) to the U.S. Department of Labor. The application will be marked with a "priority date," which is the date your application is considered. The LC is valid for 180 days.Note: Need to fill out Form I-140 and submit it to the U.S. Citizenship and Immigration Services (USCIS) before the Labor Certification expires.)

  • Submit the application for U.S. permanent residency I-140 (Immigrant Petition for Alien Worker).

Proceed with the submission of the I-140 petition (petition for foreign worker to work indefinitely in the U.S.). This petition is filed by an experienced immigration attorney on behalf of the sponsoring employer to the U.S. Citizenship and Immigration Services (USCIS). If expedited processing and faster results are desired, the applicant can opt for premium processing, with a waiting time of approximately 15 days.

  • Stage 5: apply for a visa American settlers to the center of The national visa (National Visa Center, NVC).

After the application is approved by USCIS, it will be transferred to the NVC. The applicant will pay the visa fees as instructed by the NVC.

  • Interview with the U.S. Consulate in the country where the applicant is currently residing.

After completing the application, the applicant will receive an interview appointment letter. You need to prepare the required documents, both copies and originals, to participate in the interview.

If the interview is successful, the applicant will receive the visa application (sealed) to present to Customs upon arrival in the United States.

  • Receive Green Card in the United States

Arrive in the United States to receive the Green Card, start a new life and job in the United States.
